With reference to correspondence ending with your letter No.0/1075/12 of the 3rd instant, the position with regard to the site for Howitzers at Crown Point is as follows:-
The Military Authorities propose to acquire
a mall area of land for gun platforms and possibly for small blockhouses, part of which land is privately owned, the remainder being Crown Land,
This Government is prepared to rent the Crown Land at a nominal encroachment fee of $1.00 per annum, and to resume and sell to the Military Authorities the privately owned land. It is proposed to charge for the resumed land a mm of $22.76, being the cost of resumption, and in addition a sum of $5.25, representing the Crown rent capitalised at 26 years' purchase. This land will be vested in the Secretary of State for War.
This Government is unable to accept the suggestion that the cost of the resumed land should be credited to it in the Lands Account. That Account relates to acquisition of Crown Lands by the Military Authorities and it is considered that it was not intended to include in it transactions such as the acquisition of private property. The capitalised Crown rent will, however, be credited to the Colonial Government in the Lands Account.
